Step 4 - Asylum accepted

Your asylum might be accepted based on one of the four situations mentioned in the decision-making step (Acknowledgement of entitlement, Award of refugee protection, Award of subsidiary protection, Imposition of ban on deportation). The type of stay you get in Germany then depends on the basis of the decision.

Let us take a look at these :

Art 16 a Basic Law (Acknowledgement of entitlement)

1. Residence permit with 3-year validity
2. You can get permanent residence after three or five years if other preconditions are met, such as the ability to make a secure living and adequate knowledge of the German language
3. Just like a German, you have unrestricted access to the labour market and can engage in gainful employment
4. You are entitled to reunification with your family

Section 3 Asylum act (Award of refugee protection)

1. Residence permit with 3-year validity
2. You can get permanent residence after three or five years if other preconditions are met, such as the ability to make a secure living and adequate knowledge of the German language
3. Just like a German, you have unrestricted access to the labour market and can engage in gainful employment
4. You are entitled to reunification with your family

Section 4 Asylum act (Award of subsidiary protection)

1. Residence permit with 1-year validity
2. If the residence permit is extended, you get two more years in each case
3. You can get permanent residence after five years (the duration of the asylum procedure is included) if other preconditions are met, such as the ability to make a secure living and adequate knowledge of the German language
4. Just like a German, you have unrestricted access to the labour market and can engage in gainful employment
5. You are not entitled to reunification with your family

Section 60 V and VII Residence act (Imposition of ban on deportation)

1. Residence permit with at least 1-year validity with possible repeated extension
2. You can get permanent residence after five years (the duration of the asylum procedure is included) if other preconditions are met, such as the ability to make a secure living and adequate knowledge of the German language
3. It is possible to engage in gainful employment. However, permission must be obtained from the immigration authority.
4. You are not entitled to reunification with your family

*It should be noted that if the BAMF finds reason, it might revoc or withdraw a positive decision at a later date.
